OMFG, When I read this article I started to laugh xDDDD, Holy Crap, only you Mike..
Mike says that He was "wrongfully excluded" from the group and DT were "wrongfully using the name of the band in connection with [their] recording of an album without the participation or consent of [Portnoy]. The document was filled on April 27.WOW!

it seems, Blabbermouth denied this story that Mike would be suing DT, I don't know What's really going on with these guys..
